There was a BIG RULING with BIG CHANGES for Real Estate! WHAT ARE WE GOING TO DO?
Ok, actually- yes, there was a ruling, but the changes aren't going to be that huge. Especially if you have been working with a Pro, or my Realtor friends - if you've been behaving as a pro. I will say - the state of Pennsylvania has done a lot of these things already, or at least always HIGHLY SUGGESTED best practices along these lines, so thankfully, I don't think we're going to feel the effects like some other parts of the country. Let's talk through it.
Areas where there ARE going to be some changes - Large scale shifts
1. Clearer Disclosure Requirements: The NAR now mandates enhanced transparency in property listings, requiring agents to disclose more information upfront. This includes details on potential conflicts of interest, such as dual agency arrangements, making sure clients are fully informed before entering into agreements. Agents should always be 100% clear about how they are handling their clients and their client's best interests. I can go on and on about Dual Agency (I don't usually practice dual agency, because of reasons I won't go in to here....), but it seems some agents were not upfront about what it means when they represent both the buyer and the seller. There is going to be a crack down on the rules when it comes to repping both sides. PA has always been pretty clear on what should happen in these cases and how agents should approach it, and it looks like the rest of the country is going to start following some of the same rules.
2. Stricter Code of Ethics Enforcement: With a renewed focus on upholding professional standards, the NAR has bolstered its enforcement mechanisms. Agents found in violation of the Code of Ethics may face more severe penalties, emphasizing accountability and integrity within the industry. NAR's cracking down on the naughty list - and they're going to be WAY more watchful. I think we will see a bit of "making an example of" for some cases - so agents who haven't been super careful really need to tighten up how they do some things. Again, if you've been doing it right all along, this shouldn't be causing any stress.
3. Enhanced Data Privacy Measures: In response to growing concerns over data security, the NAR has introduced stricter guidelines for handling client information. Realtors are now required to implement robust data protection measures, safeguarding sensitive data from unauthorized access or misuse. In our world of hacking and data breaches ALL OVER, this can't really be a surprise.
Areas of change - Realtor level
1. Increased Emphasis on Client Representation: The rulings underscore the importance of prioritizing client interests above all else. Realtors are encouraged to act as advocates for their clients, ensuring they receive the highest level of service and representation throughout the transaction process. Again - what we should have been doing this whole time!
2. Elevated Professionalism: The heightened emphasis on ethics and accountability elevates the professionalism of the real estate industry as a whole. Clear relationships, clear communication, and clear expectations make for better deals and happier clients!
Areas of Minimal Change - hear me out!
1. Commission Structures: I can hear you screaming at me through the screen - "What?? this has been where the BIGGEST CHANGES have happened!" Hear me out. I know a lot of the articles and "click bait" headlines have been saying things like "The 6% commission is GONE!" or "Agents won't get paid anymore!" No. Agents always have been able to and still can continue to negotiate commissions based on market conditions and individual agreements with clients. We NEVER had a "required" commission, and it was ALWAYS negotiable! Again, PA has very clear documents outlining this - so Realtors - let's learn how to communicate clearly, and show our clients that working with a Pro is absolutely worth it.
2. Market Dynamic: Despite these changes, the fundamental dynamics of the real estate market remain largely unchanged. These NAR changes HAVEN'T changes the fundamental principles of: supply and demand, interest rates, and economic conditions. Sellers are still selling, and buyers are still buying. And in my opinion, they all still need Realtors to help - because it can get messy and VERY scary out there. Having a Realtor Service Agent (see my blog about arguing a shift from "Sales Agent to Service Agent" HERE) is still a vitally important part of every Real Estate Transaction.
3. The Role of Technology: We live in a wild time, and tech makes leaping and bounding changes over night, it seems! While technology plays an increasingly vital role in real estate transactions, the recent rulings have not specifically addressed technological advancements or their impact on industry practices - but these things will be considered and probably regulated soon. Agents are encouraged to leverage technology responsibly to enhance efficiency and client service, while also maintaining a high level of honesty and transparency.
At the end of the day, the recent NAR rulings are pushing towards enhancing transparency, accountability, and professionalism within the real estate industry. So really - NOTHING SHOULD FEEL MUCH DIFFERENT. If it DOES, then yes - maybe Realtors who feel the change should worry and make the right changes towards becoming better and more professional. Agents are being told to uphold the highest level of service and integrity, which we should have been doing all the time. These changes should ultimately be benefiting both clients and the broader community, with Real Estate Agents guiding the way. And for our clients - find the right agent who is there to serve YOU.
